Potential penalties
The DUI / DWI penalty on a first offense conviction is up to a $2,500 fine and one year suspension of your driver’s license. Jail time varies widely from 1 day to 12 months, depending on circumstances such as blood alcohol content, whether it was an accident case, and whether minor children were in the vehicle.

Fighting your first offense is critical because of the heightened punishment if you are later arrested again for driving under the influence. A second offense carries a mandatory minimum jail time of 20 days if the DUI occurred within 5 years, and 10 days minimum if within 10 years of the first offense. Your driver’s license will be suspended for three years on the 2nd offense.

A third conviction within 10 years of a first drunk driving offense results in  substantial jail time, major fines and revocation of your driver’s license. A 3rd offense also gives you a felony record.
